Chairman Bob Kamps called the monthly meeting to order at 6:30 p.m. Present were the Chairman, new Plan Commissioner Merle Loomer who replaces Jack Ames who retired, Andy Schmidt, Jim Anton, Gary Cocroft, and Jim Thometz. Phyllis Olson was excused. Attorney Brian Schuk was also present at the meeting. A quorum was declared.

Gary made a motion to approve the minutes from August 17, and August 24 meetings as presented. Jim Thometz seconded the motion. The motion passed unanimously 6-0. Chairman Kamps made a motion to approve the agenda as presented. Jim Thometz seconded the motion. The motion passed unanimously 6-0.

John Mikrut-Rezone R-2 to B-2. The property is on the corner of Walnut Road and County Highway H. The plans are to build a three (3) unit retail building. John presented plans for the building. He stated he had talked to Randy Parker and the County about the entrance to his property off of Walnut Road. They agreed that would be better than County Highway H. John talked to the neighbors who signed a paper stating they had no problems with his plans for a retail business building. The neighbors are Karen Mahoney and Nancy Baker. John said he would plant arbor vitas for screening around the property. There were no calls about the rezone sign on the property. Chairman Kamps made a motion to recommend to the Town Board to approve the rezone request for John Mikrut from R-2 to B-2 for the property located on the corner of Walnut Road and County Highway H. Andy seconded the motion. Discussion-it was noted that Gary is the brother-in-law to John Mikrut so Gary did abstain his vote. The vote passed 5-0 with Gary abstaining. John will be at the October 12,2009 Town Board meeting for a decision.

Todd O’Brien-Longwood Subdivision on McDonald Road - Discussion and possible action on revisions to the Final Plat adjustments, and storm water report for the subdivision. Separate documents will be recorded for the additional protective areas. Todd stated he has been working years on the proposed subdivision. He has recorded everything with the State. He was contacted by a DNR official about the pond he has in front of the subdivision. He also has done additional erosion control on the property. Attorney Brian Schuk was present to talk to Todd about the Developer’s Agreement. In the developer’s agreement it states that the workers must be paid prevailing wages. Prevailing wages are mandated by the State of Wisconsin. Todd’s road construction company does not want to pay prevailing wages. He (Bob Stewart) does not have union employees in his business. Since the roads in the subdivision are to be constructed and become dedicated to the Town the prevailing wages must be paid, Todd then stated he wants the roads in his subdivision to remain private roads. Todd would build the roads to Town specifications, but he would maintain the roads himself so prevailing wages do not have to be paid. After a lengthy discussion about the private or dedicated roads to the Town, Chairman Kamps made a motion to recommend to the Town Board to approve the Developer’s Agreement as written final plan adjustments with restrictive covenants as presented on September 28,2009. Andy seconded the motion. The motion passed unanimously 6-0. Chairman Kamps made a motion to recommend to the Town Board to approve the Developer’s Agreement as written and or if road can be changed with Attorney agreement to a private road. Jim Thometz seconded the motion. The motion passed unanimously 6-0. Todd will be at the Town Board meeting on October 12,2009 for a decision.

Doug Olson-He will be presenting a Certified Survey Map for the Como Community Church located W3901 Palmer Road. Doug was not present at the meeting. Chairman Kamps said he would present the request, and he would abstain from any vote on the request. The certified survey map was for the house the church owns. The house would be put back on the tax roll for the Town of Geneva and Walworth County. Jim made a motion to recommend to the Town Board to approve the Certified Survey Map for Como Community Church located at W3901 Palmer Road. Andy seconded the motion. The motion passed 5-0 with one abstaining Chairman Kamps.

Mary C. Borowski N3151 Hickory Road-She is requesting a variance for a screened in porch that was built without a building permit and a 2.4-foot rear yard setback variance is needed. Mary will bring in letters from neighbors about her request. Gary will post a sign on the property. This will be decided at the next Plan Commission meeting October 26,2009.

Chairman Kamps made a motion to recommend to the Town Board to approve the fees for Chapter 18 of the Land Division and Condominium Ordinance that were discussed on August 17,2009. Jim seconded the motion. The motion passed unanimously 6-0.

Chairman Kamps made a motion to table any discussion and possible action on business license fees in the Town of Geneva. Andy seconded the motion. The motion passed unanimously to table 6-0.

There was no ETZ business.

There was no building inspector’s report because Audrey was sick.

Chairman Kamps made a motion to adjourn the meeting at 7:55 p.m. Jim Thometz seconded the motion. The motion passed unanimously 6-0.
