February 22, 2010 Plan Commission Meeting

Chairman Kamps called the monthly meeting to order at 6:30 p.m. Present were the Chairman, Andy Schmidt, Merle Loomer, Phyllis Olson, Jim Anton, Gary Cocroft, and Jim Thometz. A quorum was declared.

Merle made a motion to approve the minutes from January 25,2010 as presented. Jim T. seconded the motion. The motion passed unanimously 7-0. Andy made a motion to approve the agenda as presented. Jim Anton seconded the motion. The motion passed unanimously 7-0.

Mark Taylor-Landcraft Survey & Engineering Inc.-He will present a Certified Survey Map for three (3) parcels totaling 30 acres. A rezone for approximately 27 acres from C-1 to C-2 is requested. Current zonings on the property are R-1, C-1, C-2, C-3, C-4, and C-5. Aaron Koch presented the request for Mark Taylor. He presented a delineation of the wetlands to the Commission members. Andy questioned the size of Lot 2. He didn’t think there was enough land 40,000 square feet to build a home. Chairman Kamps made a motion to table the decision on the rezone request until the March 22,2010 meeting. Jim T. seconded the motion. The motion passed unanimously 7-0. Aaron Koch will contact Mark Taylor and the Certified Survey Map will have to be redone to allow enough square footage for each lot to be zoned correctly.

Warren Hansen will present a rezone request for Jim Willet W3803 Kelly Road. Current zoning is C-3 and the lot is 4.59 acres, and the requested zoning is A-2. A lot line adjustment and Certified Survey Map will be presented after the rezone is approved. Chairman Kamps asked if anyone called about the sign on the property. There were not any concerns. Chairman Kamps made a motion to recommend to the Town Board to approve the rezone request for Jim Willet W3803 Kelly Road from C-3 to A-2 for 4.59 acres. Jim T. seconded the motion. The motion passed unanimously 7-0. He will be at the March 8,2010 meeting for a decision.

Warren Hansen will present a rezone with a conditional use for Michael Goril who plans to open Zipliner Adventure Park at Geneva Mountain, which is located on County Highway H and County Highway NN. The property is the Ceisel gravel pit. Current zonings are A-2, A-3, C-2, and M-3. Requested zoning is 30.90 acres to P-1, and 68.94 acres to C-2. Michael Goril stated the project would be done in stages. There is enough room on the property for extra parking of cars if needed. Michael said all lights on the property will shine down and he will follow the Town Ordinance for lighting. There will be a 40’ by 80’ Welcome Center, and the sign for the park will follow County ordinance. The zipliner and canopy tours would be inspected daily. There would be a 100- foot buffer zone around the property. The hours of operation would be 7:00 A.M. to 9:00 P.M.from March to November. There were no calls about the plans for the property. The rezone request for this property would comply with the 2035 Land Use Plan. Chairman Kamps made a motion to recommend to the Town Board stating the rezone request for this property would comply with the 2035 Land Use Plan. Andy seconded the motion. The motion passed unanimously 7-0. Jim T. made a motion to recommend to the Town Board to approve the rezone request for 30.90 acres to P-1 and 68.94 acres to C-2 for the Zipliner Adventure Park at Geneva Mountain. Merle seconded the motion. The motion passed unanimously 7-0. Gary made a motion to recommend to the Town Board to approve the conditional use for Zipliner Adventure Park at Geneva Mountain and follow the plan as submitted January 7,2010 and if any deviation a new conditional use must be filed. Andy seconded the motion. The motion passed unanimously 7-0. This request will be decided at the March 8,2010 Town Board meeting.

Attorney Robert Leibsle will present an informal discussion on land use pertaining to property that is located at W2762 Krueger Road that is dual zoned. The property is 2.34 acres and is zoned M-3, and A-5. This property is under one tax key. The owners would like to rezone the M-3 to A-5 and split the property. Attorney Leibsle discussed this rezone with Building Inspector Audrey Boss. She thought the rezone would fit into the 2035 Land Use Plan. A formal request will be presented at the March 22,2010 meeting.

Cassandra Kordecki is requesting the Town to consider an ordinance or resolution to allow short -term rentals of private residences. Cassandra presented everyone present with papers of information about short- term rentals which means a week or less. She introduced County Supervisor David Weber and Walworth County Tourism Bureau person Kathy Seberg. Mr. Weber stated the County has started addressing this issue. Kathy said she is at the meeting only to hear Cassandra’s presentation. Mary read a letter from Tom Laughlin N2856 Walden Lane opposing any short-term rentals for the Town of Geneva. Cassandra stated that short-term rentals would provide the Town with more income from room tax. This issue will be addressed at the March 22,2010 Plan Commission meeting.

Public Comments; Bill Leonard W3828 South Shore Drive said he is not for short-term rentals because of rentals in his neighborhood. He asked who would enforce the rentals. Right now the Town does not have an ordinance to enforce the weekly rentals that are occurring. Gary Duffy W4086 Lake Shore Drive said he is against any short-term rentals. He said all the residents should be informed before even considering any type of short-term rental. Pauline Malsch W2802 Krueger Road said she is against any short-term rentals. David Weber said the County is trying to communicate with all Towns, Cities, and Villages looking for responses to short-term rentals.

ETZ-No reports.
Building Inspector-Audrey said she didn’t have any formal report. She did comment that any rezone should be reviewed to see if it fits into the 2035 Land Use Plan.
Chairman Kamps made a motion to adjourn the meeting at 9:02 p.m. Andy seconded the motion. The motion passed unanimously 7-0.
