January 25, 2010 Plan Commission Meeting

Chairman Kamps called the monthly meeting to order at 6:30 p.m. Present were the Chairman, Andy Schmidt, Merle Loomer, Phyllis Olson, Jim Anton, Gary Cocroft, and Jim Thometz. A quorum was declared. Pauline Malsch was the appointed recording secretary for the meeting.
Merle made a motion to approve the minutes from the November 23,2009 meeting and the amended agenda for the January 25,2010 meeting. Jim Anton seconded the motion. The motion passed unanimously.
Keith Nissen-Conditional Use-He is requesting to increase the number of outside parking spaces from one (1) to seven (7). The property is located at N3481 County H and is zoned B-2. The business is Master Plumbers. Keith had presented this request in November and waited patiently for a decision this January. Chairman Kamps made a motion to approve the conditional use to allow seven parking spaces for Keith Nissen at N3481 County H for his business Master Plumbers. Andy seconded the motion. Merle asked about future expansion, Keith responded he has no plans to expand the business but might rent out part of the building to other businesses and there will be no overnight parking. The motion passed unanimously. Keith will receive a decision at the February 8,2010 Town Board meeting.
Mark Taylor-Landcraft Survey & Engineering Inc. will present a Certified Survey Map for three (3) parcels totaling 30 acres. The property is located at W3221 Park Drive and County H. The current zonings on the property are R-1, C-1, C-2, C-3, C-4, and C-5. Mr. Taylor was informed by the County a rezone will be needed for the property that is approximately 27 acres and is currently zoned C-1. The C-1 will become C-2 and will also include wetlands. The lots will be different in size because of the rezone. The County is mandating the rezones because of the amount of land in the shoreland zoning districts. The Commission will need a copy of delineation for the records. Mr. Taylor will be at the February 22,2010 meeting for a recommendation. Gary will post a sign on the property.
Warren Hansen will present a rezone request for Jim Willet whose property is at W3803 Kelly Road. Current zoning is C-3 and the lot is 4.59 acres, and the requested zoning is A-2. The lot when it is rezoned will be 5.62 acres. A lot line adjustment and Certified Survey Map will be presented after the rezone is approved. The C-3 lot will be 7.81 after the lot line adjustment. Both lots will be substandard. Andy will post a sign. This request will receive a recommendation at the February 22,2010 meeting.
Warren Hansen will present a rezone with a conditional use for Michael Goril who plans to open Zipliner Adventure Park at Geneva Mountain, which is located on County Highway H and County Highway NN. This property is the old Ceisel gravel pit. Current zonings are A-2, A-3, C-2, and M-3. Requested zoning is 77 acres to C-2, and 10 acres to P-1. Total acreage of the property is 99.8 acres. This request will have no land divisions. The rezone of the M-3 land to C-2 means the old gravel pit will be reclaimed by Amons. The owners are planning to remove only fallen trees, and keep the healthy trees. They will improve the road off of County H for the entrance to the property. They proposed a 42x 64 building as a welcome center with a garage to store equipment with vending machines. The parking lot will hold 84 vehicles. Micheal Goril explained what a zipline is: Platforms are built with steel cables within tall trees, people would attach harness with the steel cables and ride through the trees. The age for beginners is 8-10 years old and up to older participants. They will start at highest peak in Walworth County to a central tower-Zipline Canopy tour to begin with 20’-80’ off the ground. There will rope bridges to go through a pre-set course. Zipliner fest racing will also have climbing walls. This project will be done in phases. ACCT (challenge course technology) ATV trail is for bringing visitors back to welcome center after completion of zipliner. Biking, hiking and other activities will be offered. This will begin as seasonal from March to November. An example of zipliner is Hocking Hills in Rockbridge,Ohio that started in 2008. There are only 15 commercial canopy tours available in the United States. There will be gates at the access area. This project will have minimal impact on the environment. He would like to open July 1,2010. The cost per visit is $75 to $85. Security is very guarded and guests will not be allowed to move any lines-only trained guides may. A tour will last approximately 2 hours. Maybe 2 tours can be done at the same time. All uses will be conditioned. The lighting on the property would adhere to the Town’s lighting ordinance that means all lights would face down. Andy asked about an emergency entrance and the response was yes to the northeast the utility access area. All guides will be trained for emergency needs and safety is the biggest concern. State-of-the-art equipment will be used. The property has not been purchased until the rezone is approved. A buffer zone around the property will be discussed at the February 22,2010 meeting. Chairman Kamps will post a sign on the property.
Chairman Kamps made a motion to table until the February meeting discussion and possible action concerning business licenses for the Town of Geneva. Merle seconded the motion. The motion passed unanimously.
Public Comments-Cassandra Kordecki questioned short- term rentals in Town of Geneva and Walworth County. She is asking to be regulated and taxed for short -term rentals. She will be at the February 22,2010 meeting formally presenting her request. She did a hand-out to members and the Attorney.
ETZ-no report
Audrey gave a building inspector report. She expects the future to remain flat except for Mercy Hospital should break ground this year. She explained her new PERMIT PATH a website for permit applications, and zoning requirements and more.
Smart Growth-nothing.
Chairman Kamps made a motion to adjourn the meeting at 8:25 p.m. Merle seconded the motion. The motion passed unanimously.
