MONTHLY BOARD MEETING

DECEMBER 5, 2011

 

 

Chairman Kopecky called the duly posted and noticed meeting to order at 6:13 p.m. Pledge of Allegiance.  In attendance were Kopecky, Supervisors Daily, Loomer, Kukla, Kulik, and Attorney Torhorst. Clerk/ Treasurer Kirch took the minutes of the meeting. Motion (Loomer/Daily) to approve the agenda. Approved 5?0. Motion (Kukla/Kulik) to approve the meeting minutes from November 14, 16, 17, 2011. Approved 5-0. Motion (Kukla/Daily) to approve the Treasurer’s Report as presented. Approved 5-0. Motion (Kulik/Loomer) to approve the prepaid bills from 11/05/11 through 11/26/11. Approved 5-0. Three questions were asked by Loomer. Motion (Kukla/Kulik) to approve the list of 28 Election Inspectors for the next two-year term, January 1, 2012 – December 31, 2013. Approved 5-0. Town is not able to reproduce the enclosure over the lower level staircase that was destroyed during the fire in February. Bid for $2,319 received from Trendsetters for a canopy with two side curtains with clear vinyl side windows including installation. Would be able to install before the first of the year. Motion (Loomer/ Kukla) to go ahead with it for $2,319 less the tax and see if our insurance will cover any of the cost. Approved 5-0.

 

Attorney’s Report (Torhorst) –

  • Hearing set for December 22nd on the Poulos claim of excessive assessment.
  • Working on the Letter of Credit for Center Street as it expires December 10th. Pollard signed Friday, should get today or tomorrow.
  • Unable to attend the ETZ discussion. Communicating with William’s Bay Attorney to participate in the drafting of the language that we would like.

 

Plan Commission Report (Kopecky) –

  • Walworth County Alliance for Children has requested a Conditional Use to build a 4,300 sq. ft. building (Child Advocacy Center for Walworth County) on County land along Hwy NN. Bill Henry presented the updated plans for the building. The owner of the building and property would be the Walworth County Public Works Commission. The first concern is why is the building not being built next to the nursing home which would be in the City of Elkhorn. Another concern is the building itself going to be built to look more like a house instead of all the other buildings currently on the property. The main concern from all the Commission members was there would be more responsibilities for the Town of Geneva if the facility is built next to the Human Services building. Liability for police and fire protection. Will investigate the location. Bill Henry asked to table this request until the December 19, 2011 meeting.
  • Robert and Diane Nelson W4080 Palmer Road requested a farmland separation and a Certified Survey Map to break the buildings from the farmland. Currently operating a Community Based Residential Facility. Will be on the December 19, 2011 Plan Commission agenda.
  • Lodge at Geneva Ridge W4240 Highway 50 is requesting an amendment to their current Conditional Use for senior and assisted living facilities. Plans available for viewing in the Clerk’s office. Will present additional information this month.
  • Lodge at Geneva Ridge is requesting a Conditional Use for an exterior LED sign. Sign would be two-sided and 5’ x 12’. Would enhance the look and flexibility in messaging. Has upgraded the look of the front of the building. Plan Commission recommended to approve the Conditional Use with four conditions: 1) The sign must comply with the Town of Geneva’s light ordinance; 2) Control the intensity of brightness of the sign relative to ambient conditions; 3) No strobe or flashing messages; and 4) The frequency of messages at ten-minute minimum. Nick Johnson discussed the length and time to change a message on the sign. Want the same restrictions as placed on other local signs (2 seconds vs. 10 minutes). Discussed variances vs. conditional uses for signs. William’s Bay ETZ is currently working on rewriting their sign ordinance. Motion (Kukla/Kulik) to recommend the LED exterior sign request be referred back to the Plan Commission to discuss the four conditions referenc­ing #4 the frequency of messages at ten-minute minimum. Approved 4-0. Add to the December 19 Plan Commission Agenda.
  • Mike Mumford is the new Plan Commission member.
  • Kopecky gave the Building Inspector’s Report.

 


Committee Reports –

  • Municipal Court (Kulik) – Municipal Court Clerk Senta Hall gave the Court report. Senta reported that the Town employees have adopted several families, including 17 children for Christmas.
  • Park Commission (Loomer) – Not able to attend recent meeting. Park Commission is doing a great job. Should submit budget requests earlier in the year (Sept.).
  • Police Department (Kukla) – Kukla reported that the Police Department received a radar gun from the Click or Ticket program. The Booze and Buckle program begins on December 9th. Eligible for a $4,000 grant. Lake Como Beach Property Owners Association has organized a block watch program.  Sam Gonzales would be interested in a block watch program for the rural areas of the Town. Holiday food baskets were delivered to six families. Squad has been ordered. Delivery in 120-230 days. Saved $1,400 by being on the state purchase plan.
  • Lake Como Sanitary District (Kukla/Loomer) – Daily attended recent meeting. Letter sent informing them of action taken regarding employee wage freeze for all non-represented Town employees. Expect that the LCSD Board would want to follow the same path in their budgeting process. No response received by the Town.
  • Fire Departments (Kulik/Daily) – Elkhorn had to respond to only one incident in the Town last month. Discussed the $4,500 fee for inspections included in the contract with the City of Lake Geneva. A list of inspected businesses and an invoice are to be provided. Add to January agenda to set a workshop for Ordinance #65. Email copy of ordinance to Board members.

a)      McCormick waiver not reconsidered. Motion (Kukla/Kulik) to waive the fire response invoice for Gregory Kutschma. Approved 3-1 (Loomer). Kopecky did not vote.

·          Highway Department (Loomer/Daily) – Kulik had Randy Parker open the dam as the water level is 1’ above the benchmark. Objection by some in audience to this. Loomer reported the snow plows are ready to go. Snow fence is up. Working on trimming trees. Removed the insulation from the Police garage. Drywall up. Waiting for tank and heater. Still looking for storage for tractors. Jackson Creek project is becoming a paperwork nightmare.

·          Lake Committee (Kukla) –No meeting. Nothing to report.

  • School District Report (Kulik) – Nothing to report.

 

Motion (Kukla/Daily) to approve the Original Operator License for Keith Rosenquist. Approved 5-0.

 

Motion (Loomer/Kukla) to adjourn at 7:34 p.m. Approved 5-0.
